The United States Environmental Protection Agency (EPA) recently issued a new rule aimed at protecting children from exposure to lead-based paint. According to the EPA, a million American children still poisoned by lead paint each year, putting them at risk for a wide range of health problems, including lowered IQ and behavioral disorders. Some of the poisoning is a result of common renovation activities like sanding, cutting, scraping and demolition that can create hazardous lead dust and debris by disturbing lead-based paint. Given that we typically divide American stats by 10 in order to get an approximation for Canada, that means that roughly 100,000 children in this country are being poisoned by lead paint each year.

The rule, called the Lead: Renovation, Repair and Painting Rule or RRP, came into effect on April 22, 2010. The rule applies to American renovators and maintenance professionals that work in housing, child care facilities and schools built prior to 1978. In the rule, renovation is broadly defined as any activity that disturbs painted surfaces and includes most repair, remodeling, and maintenance activities (see below). The rule applies to construction contractors, painters and other specialty trades, maintenance workers that work on homes, schools or child care facilities and landlords and property managers.

Some examples of renovation work that falls under the RPP include:

  • Sanding or scraping.
  • Removal or replacement of walls, ceilings, plumbing and or windows.
  • Weatherization projects.
  • Any activity that disturbs painted surfaces.

The rule requirements include:

  • Renovations must be performed by a Certified Firm. Firms can be individual proprietors, businesses, schools, property management companies, child care facilities and landlords.
  • Certified Firms must use Certified Renovators to perform certain activities and provide on-the-job training for uncertified workers.
  • Firms must provide education for home owners and occupants (called the Pre-Renovation Education Rule).
  • Firms must post warning signs restricting occupant access to the work area.
  • Firms must isolate the work area so that lead dust and debris does not leave the work area.
  • Workers must use lead-safe work practices during renovations, repair and painting activities.
  • After the renovation is complete, the firm must clean the work area and the Certified Renovator must verify that the cleanup was effective.

Pre-Renovation Education requirements:

  • Before starting a project, contractors, property managers, and others who perform renovations for compensation in housing or child-occupied Renovation Firms performing renovation, repair and painting projects that disturb lead-based paint must provide the Renovate Right: Important Lead Hazard Information for Families, Child Care Providers, and Schools pamphlet to owners and occupants of  housing and child-occupied facilities built prior to 1978.
  • In residential housing, the pamphlet must be provided to both the owner and occupants, and the Certified Firm is required to document the receipt or mailing of the pamphlet.
  • In multi-family residential housing, the pamphlet must be distributed to each affected unit.
  • When common areas of multi-family residential housing are affected by work, the pamphlet may be delivered to each unit or a notice can be sent to each unit telling them of the location and duration of the work and the location of information postings about lead hazards and the work to be performed.
  • In child-occupied facilities, the pamphlet must be provided to the owner, to the responsible party and to parents.
